1. SWEEPSTAKES PERIOD: The International Delight “Sweet Ride” Sweepstakes (the “Sweepstakes”) begins at 8:00 AM Eastern Time (“ET”) on September 29, 2024 and ends at 11:59 PM ET on November 10, 2024 (the “Sweepstakes Period”).
2. ELIGIBILITY: The Sweepstakes is open only to legal residents of the contiguous United States and the District of Columbia (excluding AK, CT, NJ, NV, HI, TN and WI), who are 18 years of age or older and the age of majority in the jurisdictions in which they reside as of date of entry. Employees of Danone US, LLC (“Sponsor”), Mondelez Global LLC, The Hershey Company, and FCA US LLC, their respective parent companies, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively, “Released Parties”), their immediate and extended family members (including spouses, domestic partners, biological, adoptive or step-parents, grandparents, children, grandchildren and siblings and their respective spouses, regardless of where they reside) and household members of each (whether related or not) are not eligible to participate or win. Void in AK, CT, NJ, HI, TN, WI and where prohibited by law. All applicable federal, state and local laws and regulations apply. Entry constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes (except as specifically stated below, where Administrator’s decisions are final on matters relating to the drawing). Winning a prize is contingent upon fulfilling all requirements set forth herein.
3. HOW TO ENTER: During the Sweepstakes Period, consumers can visit InternationalDelightCarSweeps.com (“Website”) and follow the instructions to complete and submit the online entry form including first name, last name, email, and phone number, to be entered into the Sweepstakes (“Entry”). Limit one (1) Entry per person during the Sweepstakes Period. Any attempt by any entrant to obtain more than one (1) Entry by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's Entries and that entrant may be disqualified. Entries generated by script, macro or other automated means and Entries by any means which subvert the Entry process are void. Entries may not be acknowledged or returned. Any use of robotic, repetitive, automatic, programmed or similar Entry methods or agents (including, but not limited to, sweepstakes Entry services to create fraudulent email addresses and/or identities) will void all Entries by that entrant. In the event of a dispute as to any Entry, the authorized account holder of the email address used to enter will be deemed the entrant and must comply with these Official Rules. “Authorized email account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winners may be required to show proof of being the authorized account holder associated with the Entry. If entering via mobile device, normal phone/data and usage charges imposed by your phone service/device may apply. You may wish to consult your wireless service provider regarding its pricing plans. Standard data rates may apply if entering via mobile device.
4. GRAND AND FIRST PRIZE RANDOM DRAWING/ODDS: On or about November 14, 2024, the Grand and First Prize winners will be selected in a random drawing from among all eligible Entries received during the Sweepstakes Period. Random drawing will be conducted by Don Jagoda Associates, an independent judging agency (“Administrator”), whose decisions are final on all matters relating to the drawing. The odds of winning a Grand or First Prize will depend on the total number of eligible Entries received during the Sweepstakes Period.
5. WINNER NOTIFICATION: The Potential Grand and First Prize winners will be required to complete a Declaration of Eligibility/Release of Liability/Publicity Release (“Declaration”), within 3 days of notification attempt or prize may be forfeited and an alternate potential winner may be selected in a random drawing from among the remaining non-winning Entries. If a potential winner fails to return the completed Declaration within three (3) days or Declaration is returned as undeliverable, entrant shall be deemed to be ineligible, the prize will be forfeited and an alternate potential winner will be selected in the manner described above. Declarations will be sent via email. Return of any prize or prize notification as undeliverable may result in disqualification and selection of an alternate potential winner in the manner described above. If an entrant is disqualified for one of the reasons mentioned above and an alternate potential winner is selected, the alternate must complete and return the required documents in the timeframe specified. Each potential winner is subject to verification by Sponsor/Administrator before his/her/their prize will be awarded. An entrant is not a winner of a prize unless and until entrant's eligibility and compliance with these Official Rules have been verified and entrant has been notified that verification is complete.
6. PRIZES & MANUFACTURER’S SUGGESTED RETAIL PRICE (“MSRP”)/APPROXIMATE RETAIL VALUE (“ARV”): One (1) Grand Prize: A new 2024 Jeep® Grand Cherokee Limited 4X4 vehicle (“Vehicle”), with MSRP of $50,295, one year’s supply of International Delight Iced Coffee*, one (1) Yeti Tundra 75 hard cooler, and one (1) check for $18,142.05 to help defray tax liability on the prize. Total ARV of Grand Prize is $69,822. Grand Prize winner must take delivery of Vehicle from the automobile dealership near winner’s residence designated by Sponsor. Neither Sponsor nor the dealer where vehicle will be picked up shall be responsible for delays in delivery of the Grand Prize and delivery is subject to availability. Sponsor, however, shall use commercially reasonable efforts, subject to availability, to deliver the Grand Prize to the designated delivery dealer within one hundred and eighty (180) days of completion of verification process. Grand Prize winner must personally retrieve the Grand Prize within thirty (30) days of written notification of delivery or he/she/they will lose his/her/their right to claim the Grand Prize. Winner must accept Vehicle as provided by Sponsor, including color, options and model chosen by Sponsor. Winner is solely responsible for all applicable taxes, insurance, licensing, registration, title fees and pick-up costs. Winner may be required to show proof of insurance and a valid U.S. driver’s license prior to taking delivery and pick up Vehicle as directed by Sponsor. Any additional Vehicle options that are not standard on the make and model of the Vehicle are the sole expense of winner. Four (4) First Prizes: One (1) year’s supply of International Delight Iced Coffee*, one (1) Yeti Tundra 75 hard cooler, and one (1) check for $499.80 to help defray tax liability. The ARV of each First Prize is $1,927.80. Total ARV for all First Prizes is $7,711.20. Total MSRP/ARV of all prizes in this Sweepstakes: $77,533.20. Prizes are not transferable or redeemable for cash. FOR ALL PRIZES, AS APPLICABLE: *For the purpose of this Sweepstakes, the Grand and First Prize “one year’s supply” is a total of one can per day for 365 days, awarded in Sponsor’s sole discretion as actual product & coupons valued at $978.20. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the sole responsibility of the winners. Winners will be issued a 1099 tax form for the actual retail value of prizes awarded. No transfer or assignment for any prize will be permitted, except at the sole discretion of the Sponsor. In Sponsor’s sole discretion, due to prize unavailability or for any other reason, Sponsor may award an alternate prize (or portion of prize) of equal value and the Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. In no event will more than the advertised number of prizes be awarded. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY (EXCEPT AS SPECIFICALLY INCLUDED WITH VEHICLE) OR GUARANTEE, EITHER EXPRESS OR IMPLIED, AND RELEASED PARTIES HEREBY DISCLAIM THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. All prize details are at Sponsor’s sole discretion.
7. GENERAL CONDITIONS, RELEASE AND LIMITATION OF LIABILITY: The Released Parties, are not responsible for lost, late, incomplete, misdirected, invalid, stolen, inaccurate, garbled or unintelligible Entries, emails, or other communications of any kind, which will be disqualified. In exchange for the right to participate in the Sweepstakes, entrants/winners agree to release, discharge and hold harmless the Released Parties from and against any and all liability (including, but not limited to, damages caused or claimed to be caused, losses, or injury or even death) arising out of participation and/or acceptance/use or misuse of any prize (including any inherent risk of travel to pick up Vehicle and/or use Vehicle), and agree to be bound by these Official Rules and Sponsor’s decisions. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. Released Parties are not responsible for other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, in the selection/announcement of the winners, the announcement of the prizes, or in any Sweepstakes-related materials. NOTICE: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. The Released Parties are not responsible for faulty, incorrect, undeliverable or mis transcribed phone/email transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer, phone or device related to or resulting from participating in or experiencing any materials in connection with the Sweepstakes, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer, device transmission, or communications of any kind that may limit a user's ability to participate in the Sweepstakes. The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims. The Released Parties assume no responsibility for undeliverable emails, including but not limited to those resulting from any form of active or passive email filtering by a user's Internet service provider and/or email client or for insufficient space in user's email account to receive email. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, misconduct or technical failures threaten the integrity of the Sweepstakes; or if a computer virus, bug, or other technical problem corrupts the administration or security of the Sweepstakes as determined by Sponsor, in its sole discretion. In the event of termination, the random drawing will be conducted from among all among all non-suspect, eligible Entries received prior to termination or prizes will be awarded as otherwise deemed fair and appropriate by Sponsor. Any damage made to Website by an entrant will be the responsibility of the entrant and/or the authorized email account holder of the email address associated with the Entry. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
8. Disputes: Except where prohibited, Sponsor reserves the right to make all decisions in its sole discretion arising out of or relating to the Sweepstakes. Except where prohibited, by entering, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, exclusively before a federal or state court located in Westchester County, New York (and you consent to the personal jurisdiction of such courts and to waive any right of inconvenient forum, change of venue or any like right); (b) any and all claims, judgments, and awards shall be limited to actual damages incurred of no more than ten dollars ($10), including costs associated with participation in the Sweepstakes, but in no event attorneys’ fees; and (c) without limiting the foregoing, YOU WAIVE THE RIGHT TO CLAIM ANY OTHER DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, PUNITIVE, CONSEQUENTIAL, OR INDIRECT DAMAGES and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of New York in the United States of America, without giving effect to any choice of law or conflict of law rules.
EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER AGAINST THE RELEASED PARTIES. SECTION 1542 READS AS FOLLOWS:
“CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
9. PRIVACY: Any personal information that an entrant provides in connection with the Sweepstakes shall be used by Sponsor and Administrator to administer this Sweepstakes, contact entrants, and for the other purposes set forth in the Sponsor’s privacy policy located at http://www.danonenorthamerica.com/privacy-policy.html. By entering this Sweepstakes, you acknowledge that you have read, agree to, and accept that privacy policy. You may choose to stop receiving marketing emails by following the unsubscribe instructions included in these e-mails. This section does not limit any other consent(s) that an entrant may provide the Sponsor in relation to the collection, use and/or disclosure of their personal information. If you are a verified prize winner, your name, city and state may also be included in a publicly available Winners’ List.
10. Winners List: For the Winners List, available after November 30, 2024, send an email within ninety (90) days to: winners@dja.com with the subject line International Delight “Sweet Ride” Sweepstakes Winners. Winners’ List will be sent after the prizes have been fulfilled.
